EPF Withdrawal Rules and Tax 2026 — When It's Tax-Free and When TDS Applies

EPF (Employees' Provident Fund) is one of the most important retirement savings instruments for salaried employees. Understanding when withdrawals are tax-free and when TDS applies is critical before making any withdrawal.

The 5-Year Rule — Most Important

EPF withdrawal is completely tax-free if you have completed 5 years of continuous service.

The 5-year clock counts total service across employers, provided the EPF account was transferred (not withdrawn) between jobs.

Example:

  • Employer A: 3 years (EPF transferred to Employer B)
  • Employer B: 2 years
  • Total continuous service: 5 years → Tax-free withdrawal

If you withdrew EPF from Employer A instead of transferring, the clock resets.

When TDS Applies

TDS at 10% is deducted if:

  • You withdraw EPF before completing 5 years of continuous service
  • The withdrawal amount exceeds ₹50,000

If PAN is not provided: TDS at 20% (maximum marginal rate).

If withdrawal is below ₹50,000: No TDS, but the amount is still taxable in your hands.

What is Taxable in Premature Withdrawal?

When you withdraw EPF before 5 years, the following are taxable:

  • Employee's contribution: Taxable if deduction was claimed under Section 80C
  • Employer's contribution: Fully taxable
  • Interest on both: Fully taxable

If you did not claim 80C deduction on your EPF contributions (e.g., you were under the new tax regime), only the employer's contribution and interest are taxable.

How to Avoid TDS on EPF Withdrawal

Submit Form 15G (below 60 years)

If your total income for the year is below the taxable limit, submit Form 15G to EPFO before withdrawal. EPFO will not deduct TDS.

Eligibility:

  • Age below 60
  • Estimated total income for the year is below the basic exemption limit
  • Tax liability for the year is nil

Submit Form 15H (60+ years)

Same as Form 15G but for senior citizens.

Partial Withdrawal Rules

EPFO allows partial withdrawals for specific purposes without tax implications (if 5-year rule is met):

Full Withdrawal Rules

Full EPF withdrawal is allowed when:

  • Retirement at age 58
  • Permanent disability
  • Migration abroad for permanent settlement
  • After 2 months of unemployment (full balance)

How to Withdraw EPF Online

  1. Login to epfindia.gov.in with UAN and password
  2. Go to Online Services → Claim (Form-31, 19, 10C & 10D)
  3. Verify bank account (must be linked to UAN)
  4. Select claim type (full withdrawal, partial withdrawal, pension)
  5. Submit — amount credited within 15-20 working days

No employer approval needed for most claims if Aadhaar is linked to UAN.

EPF Withdrawal and ITR Filing

If TDS was deducted on EPF withdrawal, it appears in Form 26AS. Report the withdrawal amount in your ITR under "Income from Other Sources" or "Salary" (depending on the nature).

If you believe the withdrawal is tax-free (5-year rule met), report it as exempt income.

Frequently Asked Questions

Is EPF interest taxable?

EPF interest is tax-free up to a contribution of ₹2.5 lakh per year (₹5 lakh for government employees). Interest on contributions above this limit is taxable from FY 2021-22 onwards.

What if I change jobs and withdraw EPF instead of transferring?

The 5-year clock resets. The withdrawal from the previous employer is taxable if total service was less than 5 years.

Can I withdraw EPF if I am still employed?

Partial withdrawals are allowed for specific purposes (medical, marriage, education, home). Full withdrawal is only allowed after retirement or 2 months of unemployment.
